Please read these Terms and Conditions carefully. By placing a booking, making payment (in full or in part), signing a Rental Order, or accepting hand-over of any Equipment, you agree to be legally bound by this Agreement in its entirety.

1. Introduction and Acceptance of Terms
This Equipment Rental Agreement ("Agreement" or "Terms") is entered into between Red Dot Holdings LLP, trading as Red Dot Photo ("Red Dot Photo", "we", "us", "our"), and the individual or company renting Equipment from us ("Renter", "Lessee", "you", "your"), whether the booking is made through our Website (www.reddotphoto.com.sg), our Shopify storefront, in person at our premises, or through WhatsApp, phone, email, or other offline channels.
1.1 This Agreement is accepted and becomes legally binding on you when any of the following occurs, whichever is earliest: (a) you complete checkout and check the "I have read and accept these Rental Terms and Conditions" box on our Website; (b) you make full or partial payment of any rental fee or deposit; (c) you or your authorised proxy sign a Rental Order, delivery note, or acknowledgement of receipt; or (d) you or your authorised proxy take possession of the Equipment.
1.2 You agree to be bound by this Agreement regardless of whether you have read it in full. If you do not agree to these Terms, you must not proceed with any booking and must not accept delivery or collection of any Equipment.
1.3 If you are renting on behalf of a company, production house, school, or other organisation, you represent that you have full authority to bind that organisation to this Agreement, and "you" shall include that organisation, with you personally remaining jointly and severally liable.
2. Definitions
In this Agreement, unless the context requires otherwise:
(a) "Equipment" means any item(s) of gear made available for rental by Red Dot Photo, including but not limited to camera bodies, lenses, studio strobes/flash units, continuous/LED video lights, light modifiers (softboxes, umbrellas, beauty dishes, reflectors), light stands, C-stands, tripods, monopods, gimbals, sliders, microphones, audio recorders, wireless transmitter/receiver systems, action cameras, drones, monitors, batteries, chargers, memory cards, cases, and any accessories, cables, or components supplied with such items.
(b) "Rental Order" or "Order" means the booking confirmation, invoice, quotation, or agreement (in physical or electronic form) that specifies the Equipment rented, the Rental Period, the Rental Fee, the Security Deposit, and any other applicable charges.
(c) "Rental Period" means the period from the agreed collection/delivery date and time ("Rental Start") to the agreed return date and time ("Rental End") as stated in the Rental Order.
(d) "Security Deposit" means the refundable sum collected by us to secure your obligations under this Agreement, as further described in Clause 6.
(e) "Replacement Value" means the current retail price of new equipment of the same or comparable model, as reasonably determined by us, or where such model is discontinued or unavailable, the nearest equivalent replacement, plus reasonable administrative costs.
(f) "Website" means www.reddotphoto.com.sg and any associated Shopify checkout pages operated by Red Dot Photo.
3. Eligibility and Identity Verification
3.1 Minimum age. The Renter must be at least 18 years of age. Renters below 18 years of age may only rent Equipment with the written consent of, and under the account of, a parent or legal guardian who assumes full responsibility under this Agreement.
3.2 Verification documents. Before any Equipment is released, first-time Renters (and returning Renters at our discretion) must provide, and permit us to make a copy or record of:
• A valid government-issued photo identification (NRIC, FIN card, or passport);
• A recent proof of residential address dated within the last three (3) months (e.g. utility bill, bank/credit card statement, telco bill), where the item(s) rented, rental value, or your risk profile warrants this; and
• For non-residents/tourists: passport biodata page, proof of Singapore accommodation (hotel booking or host address), and return/onward travel itinerary.
3.3 We reserve the right, at our sole discretion, to conduct reasonable checks (including identity verification, payment/fraud screening, and review of prior rental history with us) before approving any booking, and to refuse, limit, or cancel any Order without being obliged to give a reason, including where verification documents are incomplete, inconsistent, or not provided by the time of collection. Where an Order is cancelled for this reason, cancellation charges under Clause 10 shall apply.
3.4 You warrant that all information provided to us (identity, contact, payment, and delivery details) is true, current, and accurate, and you agree to promptly notify us of any changes.
4. Booking, Order Confirmation and Order Acceptance
4.1 A booking request (whether made online, via WhatsApp, phone, email, or in-store) is an offer to rent, and does not guarantee availability of the Equipment until we have issued a written or system-generated Order confirmation.
4.2 We reserve the right to accept, decline, partially fulfil, or offer a reasonable substitute for any Order, at any time prior to hand-over, including where Equipment becomes unavailable due to prior damage, loss, servicing needs, or late return by a previous renter. Where this affects your Order, we will inform you as soon as reasonably possible and, where a substitute is not accepted by you, refund any amount paid for the unavailable item(s).
4.3 We reserve the right to change product descriptions, images, availability, or pricing on our Website at any time without prior notice, and to limit order quantities.
5. Rental Fees and Payment Terms
5.1 Unless otherwise agreed by us in writing, full payment of the Rental Fee, Security Deposit, and any delivery/collection charges is required in advance of Rental Start, before Equipment is released to you.
5.2 Accepted payment methods include PayNow, bank transfer, credit/debit card via our Shopify checkout, and other methods as stated on our Website. All amounts are in Singapore Dollars (SGD) and inclusive of GST where applicable.
5.3 Rental Fees are calculated on a per-day basis unless otherwise stated on the product listing or Order. Where discounted multi-day rates apply, these will be reflected in the Order.
5.4 Failed, reversed, or charged-back payments will be treated as non-payment. We reserve the right to suspend or cancel any Order, or to withhold release/return of Equipment, until outstanding amounts are settled in full.
6. Security Deposit
6.1 We may require a refundable Security Deposit before releasing Equipment. The amount is determined based on the Replacement Value of the Equipment, your rental history, residency status, and/or item risk profile, and will be stated in your Order.
6.2 The Security Deposit may be collected in cash, PayNow, bank transfer, or via a temporary hold/authorisation on a credit card. Where a guarantor is required in place of or in addition to a deposit, this will be communicated to you prior to collection.
6.3 Following the return and inspection of the Equipment (see Clause 12), the Security Deposit, less any deductions properly chargeable under this Agreement (including but not limited to late fees, cleaning fees, repair or replacement costs, and missing-accessory charges), will be refunded to you via your original payment method within seven (7) to fourteen (14) business days.
6.4 Where deductions exceed the Security Deposit held, you remain liable for the shortfall, which shall be paid to us within seven (7) days of our written notice.
6.5 Our acceptance of a Security Deposit is not a limitation or cap on your liability under this Agreement; it is security only, and full liability for loss, damage, or other breach as set out in this Agreement continues to apply.
7. Rental Period, Collection and Return
7.1 The Rental Period runs from Rental Start to Rental End as stated in your Order. You are responsible for the Equipment for the entire Rental Period, including during transit, regardless of whether the Equipment is in active use.
7.2 Equipment must be collected and returned at the location, date, and time stated in the Order. A grace period of thirty (30) minutes after the stated return time is allowed before late charges under Clause 9 apply.
7.3 If you (or your authorised proxy) fail to show up within the agreed collection or return window without at least two (2) hours' prior notice, this will be treated as a "no-show". No refund will be given for a no-show, and any re-arranged delivery, collection, or return will be separately chargeable at our standard rates.
7.4 Where collection is made by a proxy on your behalf, you remain fully responsible for the Equipment and this Agreement, and warrant that the proxy is duly authorised by you to accept the Equipment and to sign any Order or acknowledgement on your behalf. We may request identification from the proxy before releasing Equipment.
8. Extension of Rental Period
8.1 If you wish to extend your Rental Period, you must request this before Rental End, subject to availability (i.e. the Equipment is not booked for a subsequent Renter) and payment of the additional Rental Fee at our prevailing rate.
8.2 Where an extension cannot be accommodated due to a conflicting booking, we will inform you as soon as reasonably possible, and you must return the Equipment by the original Rental End. Failure to do so will be treated as a late return under Clause 9.
9. Late Return, Non-Return and Default
9.1 Late fees. If Equipment is not returned by Rental End (beyond the grace period in Clause 7.2) without a pre-approved extension, late fees will apply at the rate of one (1) full day's Rental Fee per Equipment item for each day or part-day the Equipment remains outstanding, in addition to any inconvenience fee under Clause 9.2.
9.2 Inconvenience fee. Where a late return causes us to be unable to fulfil a confirmed booking to another renter, or otherwise causes commercial loss or disruption to our operations, we may additionally charge an inconvenience fee equivalent to one (1) to fourteen (14) days' Rental Fee for the affected item(s), depending on the severity of disruption caused.
9.3 Deemed non-return. If Equipment is not returned within three (3) days after Rental End, we may treat this as a non-return and charge you the full Replacement Value of the Equipment (in addition to accrued late fees up to that point), whereupon title to any recovered proceeds shall be dealt with per Clause 22.
9.4 Default. If Equipment remains outstanding seven (7) days after Rental End, you will be considered in default under this Agreement, and Clause 21 (Default and Recovery) shall apply, including our right to lodge a police report for suspected misappropriation.
10. Cancellation, Rescheduling and Refunds
10.1 Cancellations must be made in writing (email or WhatsApp) and are subject to the following charges, calculated on the total Rental Fee (Security Deposits and delivery charges, where already collected, are refunded in full save as set out below):

10.2 Special-order items — Equipment sub-rented or specially sourced from a third party specifically for your booking — are non-refundable and non-cancellable once confirmed, regardless of notice given.
10.3 You may request a one-time rescheduling of your Rental Period to another date within ninety (90) days of the original Rental Start, subject to availability and any price difference. No refunds, credits, or further date changes will be given once a reschedule is confirmed.
10.4 No refunds, discounts, or credits are given for early returns, partial use, or unused Equipment.
10.5 We reserve the right to cancel any Order and refund all amounts paid (without further liability to you) where Equipment becomes unavailable due to circumstances beyond our reasonable control, or where verification under Clause 3 is not satisfactorily completed.
11. Delivery and Self-Collection
11.1 Equipment may be collected at our premises or delivered to a location of your choice within Singapore, subject to availability of our delivery service and payment of applicable delivery/collection charges, which are borne by you unless otherwise agreed.
11.2 Delivery and collection time-slots provided are best estimates only. We are not liable for delays caused by traffic, weather, courier third parties, or other circumstances outside our reasonable control, and such delays do not entitle you to cancel your Order without charge unless caused by our gross negligence.
11.3 Where a scheduled delivery or collection attempt fails due to your unavailability or inability to receive/hand over the Equipment, a re-attempt fee will apply, and the Rental Period will continue to run (i.e. rental charges are not paused) unless we agree otherwise in writing.
11.4 Risk in the Equipment passes to you upon collection or delivery, and reverts to us only upon our actual receipt and inspection of the returned Equipment. Loss or damage occurring during transit arranged by you (e.g. via a third-party courier or grab delivery not appointed by us) remains your full responsibility.
12. Equipment Inspection, Condition and Acceptance
12.1 Equipment is tested and in good working condition prior to hand-over unless otherwise disclosed. You are strongly encouraged to inspect the Equipment at the point of collection/delivery and to raise any concerns immediately.
12.2 Any pre-existing damage, malfunction, or missing accessory must be reported to us in writing (with photo/video evidence where possible) within twenty-four (24) hours of receipt. Failure to do so will be taken as your acknowledgement that the Equipment was received complete and in good working order, and you will bear responsibility for any damage discovered upon return.
12.3 Upon return, we will inspect the Equipment within a reasonable time. Our acceptance of the returned Equipment at the point of hand-over (e.g. a quick visual check) does not constitute a final determination of its condition or a waiver of any claim we may subsequently identify upon full inspection or testing.
13. Use of Equipment — Permitted Use and Restrictions
13.1 General standard of care. You shall use the Equipment only for its intended purpose, in a careful, competent, and proper manner, and shall comply with all applicable laws, regulations, and manufacturer guidelines regarding its use, storage, and transport. You shall keep the Equipment clean and in good working order throughout the Rental Period, at your own expense.
13.2 No sub-renting. You shall not sub-rent, lend, pledge, assign, or otherwise part with possession of the Equipment to any third party without our prior written consent.
13.3 Category-specific care requirements
Given the broad range of gadgets we rent, the following specific precautions apply. This list is illustrative and not exhaustive — the general standard of care in Clause 13.1 always applies:
• Studio strobes / flash units: Do not operate without the correct light modifier attached where required by the manufacturer (bare-bulb overheating risk); allow adequate cool-down between bursts; do not expose to rain or high humidity; use only compatible sync cables/triggers.
• Continuous / LED video lights: Ensure adequate ventilation during extended use to prevent overheating; do not cover the unit with fabric, gels, or diffusion material in a manner that blocks airflow.
• Light modifiers (softboxes, umbrellas, beauty dishes, reflectors): Keep away from open flame and direct heat sources; dry thoroughly before repacking if used outdoors or near water; collapsible frames must not be forced beyond their natural fold points.
• Light stands, C-stands and tripods: Do not exceed the manufacturer's stated maximum load; use sandbags/counterweights for outdoor or top-heavy setups; do not leave erected and unattended in windy or high-traffic areas.
• Microphones and wireless audio systems: Protect from moisture, wind-blast, and static; wireless transmitters/receivers must not be used in a manner that breaches Singapore's radio-frequency spectrum regulations administered by IMDA; do not immerse or use lavalier mics in situations with high sweat/water exposure without proper wind/moisture protection.
• Action cameras and accessories: Use only within the manufacturer's rated depth/impact/temperature specifications; a protective/waterproof housing must be used for any underwater, extreme sports, or high-impact activity — such use is entirely at your own risk, and we do not warrant the Equipment's suitability for extreme conditions.
• Batteries, chargers and power banks: Use only the charger and cables supplied with the Equipment or manufacturer-approved equivalents; do not charge unattended overnight or leave batteries in direct sunlight/hot vehicles; damaged, swollen, or leaking batteries must be reported immediately and not used.
• Memory cards and data storage: Unless expressly included in your Order, memory cards/storage media are not provided or, where provided, are provided "as-is" without warranty as to capacity or reliability. See Clause 20 (Data) for further limitations.
13.4 Prohibited uses. You must not use the Equipment: (a) for any unlawful purpose; (b) in a manner that infringes any third party's rights; (c) in hazardous environments (e.g. corrosive, flammable, or extreme-temperature environments) without appropriate protective measures; or (d) outside Singapore, except as permitted under Clause 18.
14. Loss, Theft and Damage — Liability and Charges
14.1 You are fully responsible for the Equipment from the time of collection/delivery until it is returned to and accepted by us, including loss, theft, or damage howsoever caused, save where due to our proven negligence or a manufacturing defect not attributable to your use.
14.2 Loss or theft must be reported to us and to the Singapore Police Force within twenty-four (24) hours of discovery. You must provide us with a copy of the police report upon request.
14.3 Where Equipment is lost, stolen, or damaged beyond economical repair, you shall pay us the Replacement Value of the item, plus any applicable administrative fee. Where Equipment can be repaired, you shall bear the reasonable cost of repair by us or our appointed service provider.
14.4 Where the cause or timing of damage is disputed, the Equipment will be assessed by an independent professional repair facility of our choosing, and both parties agree to be bound by that facility's assessment as to cause, liability, and cost.
14.5 Downtime / inconvenience fee. Where damage, loss, or a missing accessory renders the Equipment unusable for a subsequent confirmed booking, we may additionally charge an inconvenience fee of one (1) to fourteen (14) days' Rental Fee, reflecting lost rental income and administrative disruption, separate from repair/replacement costs.
14.6 You remain liable for the full amounts under this Clause regardless of whether you have arranged your own insurance, and regardless of the outcome of any insurance claim (see Clause 17).
15. Repairs and Unauthorised Alterations
15.1 You must not attempt to repair, service, disassemble, open, or materially alter the Equipment, or remove/alter any serial number, firmware, or manufacturer labelling, without our prior written consent.
15.2 Where unauthorised alteration is made, you are responsible for the reasonable cost of restoring the Equipment to its original condition, in addition to any other charges under this Agreement.
16. Cleaning Fee
16.1 Equipment must be returned in a reasonably clean condition. A cleaning fee (ranging from S$20 to S$150 depending on severity and item type) will apply where Equipment is returned with sand, mud, dirt, powder, food/liquid residue, odour (including smoke), pet hair, or other substances requiring professional cleaning or decontamination beyond normal wear.
17. Insurance
17.1 Unless expressly stated otherwise in your Order, Red Dot Photo does not provide insurance coverage for rented Equipment, and you are strongly encouraged to arrange your own insurance (e.g. personal effects, travel, or equipment insurance) to cover the Replacement Value of the Equipment while in your care, custody, or control.
17.2 Where we offer an optional damage waiver or protection plan for a stated fee, its specific terms, coverage, and exclusions will be set out separately in your Order and will only apply where expressly purchased and confirmed by us in writing; it does not cover loss, theft, gross negligence, or prohibited use under Clause 13.4 unless expressly stated.
18. Use of Equipment Outside Singapore
18.1 Equipment may not be taken out of Singapore without our prior written approval. Approval may be subject to additional deposit, insurance, or documentation requirements (e.g. proof of travel itinerary and return date).
18.2 Non-Singapore-resident Renters (tourists / short-term visitors) may not bring Equipment out of Singapore under any circumstances, save where we expressly agree otherwise in writing.
18.3 Where overseas use is approved, you remain fully responsible for compliance with import/export controls, customs duties, and any foreign regulations applicable to the Equipment (including drone and RF-transmitting equipment regulations), and you bear all associated risks and costs.
19. Indemnity
19.1 You agree to indemnify and hold us harmless from and against any and all losses, damages, claims, demands, costs, and liabilities of any kind (including reasonable legal costs) arising from or relating to the use, transportation, possession, or operation of the Equipment during the Rental Period, however caused and by whomsoever used or operated, including claims by third parties.
19.2 This indemnity survives the return of the Equipment and the termination or expiry of this Agreement, in respect of any event occurring during the Rental Period.
20. Limitation of Liability and No Guarantee of Results
20.1 We do not guarantee, warrant, or assume responsibility for the performance of the Equipment once it leaves our possession, save for latent manufacturing defects not caused or contributed to by you.
20.2 If you are covering a time-sensitive or irreplaceable event (e.g. a wedding, live performance, or other one-time occasion), you are strongly advised to arrange backup equipment. To the fullest extent permitted by law, we shall not be liable for any missed shots, footage, or event coverage, or any indirect, incidental, or consequential loss (including loss of business, revenue, or opportunity) arising from equipment malfunction, delay, or unavailability, whether or not caused by our negligence.
20.3 Data. We are not responsible for any loss of, or failure to save, data or footage on any storage medium provided with the Equipment (built-in or external). You must remove all personal data/content from the Equipment before return; we are not responsible for any data left on returned Equipment and may erase it without notice.
20.4 To the fullest extent permitted by law, our total aggregate liability to you under or in connection with this Agreement, however arising, shall not exceed the total Rental Fees paid by you for the specific Order giving rise to the claim, save that this limitation shall not apply to liability that cannot be excluded or limited under Singapore law (e.g. liability for death or personal injury caused by our negligence).
21. Default and Recovery of Sums Owed
21.1 You will be in default under this Agreement if you: (a) fail to return Equipment as set out in Clause 9; (b) fail to pay any sum due under this Agreement when due; (c) breach any material term of this Agreement; or (d) provide false or misleading information to us.
21.2 Upon default, all sums owed by you to us become immediately due and payable, and we may, without further notice: (a) charge interest on overdue amounts at two percent (2%) per month (24% per annum), or the maximum rate permitted by law if lower; (b) engage a debt collection agency or take legal action to recover sums owed, with reasonable collection and legal costs recoverable from you; (c) where lawful, repossess the Equipment; (d) lodge a police report; and (e) refuse future bookings from you.
22. Ownership of Equipment
22.1 The Equipment remains the sole property of Red Dot Photo (or our third-party equipment partners, where applicable) at all times. Nothing in this Agreement transfers ownership of the Equipment to you, and you shall not represent yourself as the owner or create any charge, lien, or third-party interest over the Equipment.
23. Force Majeure
23.1 Neither party shall be liable for any failure or delay in performance under this Agreement to the extent caused by events beyond its reasonable control, including but not limited to natural disasters, extreme weather, epidemic/pandemic, government action, strikes, or failure of third-party logistics providers, provided that the affected party promptly notifies the other and uses reasonable efforts to mitigate the impact.
24. Personal Data and Privacy
24.1 We collect and use your personal data (including identification, contact, and payment information) for the purposes of processing your booking, verifying your identity, enforcing this Agreement, and communicating with you regarding your rental, in accordance with the Singapore Personal Data Protection Act 2012 (PDPA).
24.2 By entering into this Agreement, you consent to us contacting you via call, SMS, WhatsApp, or email regarding your rental, and to us retaining copies of your verification documents for our records and for future bookings, in accordance with our Privacy Policy available on our Website.
25. Governing Law and Dispute Resolution
25.1 This Agreement is governed by and construed in accordance with the laws of the Republic of Singapore.
25.2 The parties shall first attempt to resolve any dispute arising out of or in connection with this Agreement through good-faith negotiation. If unresolved within fourteen (14) days, the dispute shall be submitted to the exclusive jurisdiction of the courts of Singapore, save that we retain the right to pursue urgent injunctive or equivalent relief in any competent jurisdiction.
26. General Provisions
26.1 Entire Agreement. This Agreement, together with the applicable Rental Order, constitutes the entire agreement between you and us regarding the rental of the Equipment, and supersedes all prior discussions, representations, or agreements, whether oral or written, save for any fraudulent misrepresentation.
26.2 Amendments. We may update these Terms from time to time; the version in force at the time your Order is accepted under Clause 1.1 shall apply to that rental. The current version will always be published on our Website.
26.3 No Waiver. Our acceptance or return of Equipment, or any failure or delay by us in enforcing any term of this Agreement, shall not constitute a waiver of any of our rights or claims, including claims for damage discovered after return. No waiver is effective unless made in writing by our authorised representative.
26.4 Severability. If any provision of this Agreement is held invalid or unenforceable by a court of competent jurisdiction, that provision shall be limited or severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
26.5 Assignment. You may not assign or transfer your rights or obligations under this Agreement without our prior written consent. We may assign this Agreement in connection with a transfer of our business.
26.6 Third Parties. A person who is not a party to this Agreement has no right under the Contracts (Rights of Third Parties) Act 2001 to enforce any term of this Agreement.
